What is Neonatal Care Leave?

Definition

A new statutory entitlement allowing eligible employees to take up to 12 weeks of paid leave when their baby requires neonatal care. This leave is in addition to maternity, paternity, and shared parental leave entitlements.

UK Context

Introduced by the Neonatal Care (Leave and Pay) Act 2023, with regulations expected to bring it into force from April 2025. The leave is available from day one of employment. Statutory Neonatal Care Pay is available to those who meet qualifying conditions including minimum earnings. The baby must be admitted to neonatal care within 28 days of birth.

Who qualifies for neonatal care leave?

Employees whose baby is admitted to neonatal care within 28 days of birth and who stays for 7 or more continuous days. Both parents are eligible. The leave right is available from day one of employment; pay requires minimum service and earnings.

How is neonatal care leave taken?

The leave can be taken in blocks of one week. Tier 1 leave (during the neonatal care period) must be taken consecutively. Tier 2 leave (after neonatal care ends) is more flexible and can be taken in non-consecutive weeks within a set period.
