UK Statutory Sick Pay Rules
Who Qualifies
Employees qualify for SSP if they earn at least £123 per week (the Lower Earnings Limit), have been sick for 4 or more days in a row, and have notified their employer within the required timeframe.
Waiting Days
SSP is not paid for the first 3 qualifying days of sickness (waiting days). However, if an employee has received SSP within the last 8 weeks, these periods link and no additional waiting days apply.
Current Rate
As of April 2025, the SSP rate is £118.75 per week. This is a flat rate - all eligible employees receive the same amount, regardless of their normal pay.
Duration
SSP can be paid for up to 28 weeks. After this, employees may be able to claim Employment and Support Allowance (ESA) from the Department for Work and Pensions.
Employer Responsibilities
Employers must pay SSP to eligible employees. They cannot recover SSP costs from HMRC (the SSP rebate scheme ended in 2014). SSP is subject to tax and National Insurance.
