What is Right to Work Digital Checks?

Definition

The updated methods for conducting right to work checks in the UK, including the use of Identity Service Providers (IDSPs) for British and Irish citizens and the Home Office online checking service for those with biometric immigration documents or settled/pre-settled status.

UK Context

From October 2022, the Home Office introduced Identity Document Validation Technology (IDVT) allowing employers to use certified Identity Service Providers to verify British and Irish passports digitally. Manual in-person checks remain an option but video call checks (introduced during COVID-19) are no longer accepted. Employers using IDSPs have a statutory excuse against a civil penalty.

Best Practices

  • Choose a certified IDSP provider to streamline digital right to work checks for British and Irish passport holders
  • Maintain a clear record of which check method was used for each employee in case of a Home Office audit
  • Train hiring managers on the current acceptable methods and ensure no candidate is disadvantaged by the check method used

Frequently Asked Questions

What is an Identity Service Provider (IDSP)?

An IDSP is a certified organisation that uses Identity Document Validation Technology to verify identity documents digitally. Employers can use a certified IDSP to conduct right to work checks for British and Irish passport holders without needing to see the original document in person.

Can right to work checks still be done manually?

Yes, manual in-person checks remain a valid option for all document types. The employer must see the original documents in person, check their validity, make a clear copy, and record the date of the check. Video call checks are no longer permitted.
